- Terms and Conditions of Entry
- This document sets out the terms and conditions for TopGeek 2.0.
- These terms and conditions, the entry form and other details are available at topgeek.iinet.net.au
- This is a game of skill and chance plays no part in determining the finalists, wildcards or winners.
- By entering a submissions to TopGeek 2.0, entrants (“you”) indicate that you have read, understood and agreed to these terms and conditions.
- The Promoter of TopGeek 2.0 is iiNet Ltd: Level 1, 502 Hay Street, Subiaco 6008; ABN 90 073 119 285; Telephone number (08) 6263 3812; Website www.iinet.net.au.
- Eligibility
- TopGeek 2.0 is open to all permanent residents of Australia over the age of 18 years at the time of entry.
- Employees of iiNet Ltd are not eligible to become part of the Top 50 or proceed any further in the TopGeek 2.0 competition
- Competition
- The Top Geek competition commences 20/02/2012. The final round will be held live in Perth, WA on 10/05/12 and the final winner will be announced at the end of the final event.
- To make a submission, you must:
- complete the entry form
- upload a photography of yourself
- upload a video audition (optional for the initial entry, but is required to continue further in the competition)
- Participants must visit topgeek.iinet.net.au to upload their photo and create a profile. Video submissions will need to be emailed in a compatible format to topgeek@iinet.net.au or else uploaded to YouTube and download access details emailed to topgeek@iinet.net.au. Entries must be completed and submitted on topgeek.iinet.net.au to be eligible. Entries cannot be submitted by any other form or method. The Promoter accepts no responsibility for any late, lost or misdirected orders/entries.
- You may only submit one audition.
- Entry to TopGeek 2.0 is free; however any costs associated with accessing the website are your responsibility and may depends on your Internet service provider.
- Entrants are solely and fully responsible for the content of any of their submissions to ‘iiNet Top Geek’. Submissions must strictly conform to the following guidelines:
- Submissions to ‘iiNet Top Geek’ must originate with the entrant and be accurate and may not infringe any third-party rights, including, but not limited to, copyright, trademark, publicity, or privacy rights. When entrants make a Submission, they acknowledge that they have all necessary rights, including copyright in the material contained in their Submission.
- Submissions must not be false, misleading, deceptive, fraudulent, libellous, defamatory, obscene, pornographic, harassing, abusive, threatening, racially offensive, offensively directed towards people based on their gender, sexual orientation or otherwise discriminatory or be otherwise objectionable. If there is any question as to what constitutes objectionable material under these Terms of Use, the Promoter is the final arbiter of what does or does not constitute objectionable material.
- Submissions must not be harmful to minors in any way.
- Submissions must not and must not be intended to exploit any material for commercial purposes or advertise or solicit funds.
- Submissions must not use ‘iiNet Top Geek’ to advocate or offer instructions as to illegal activities or to violate any applicable laws.
- Submissions must be your original work.
- Submissions must not be in violation of the guidelines set forth in these Terms of Use. Any such actions shall be a material breach of these Terms of Use. The Promoter will remove any Submissions that violate any provision of these Terms of Use and will cooperate fully with any law enforcement officials and/or agencies in the investigation of any violator or violators.
- Incomplete, inaudible, incomprehensible and illegible entries will be deemed invalid as determined by the Promoter. This decision will be final and no correspondence entered into.
- iiNet reserves the right to verify the validity of all submissions. Submissions that aren’t fully complying with the above conditions will be deemed invalid.
- Judging the winner
- iiNet will judge valid submissions received during the first submission period.
- iiNet will judge your submission on its creativity, originality, entertainment value and adherence to the criteria.
- The finalists will be as announced by the Promoter on the website topgeek.iinet.net.au and/or by direct.
- Decisions are final, subject to the deliberations of the appointed judging panel. iiNet will not enter into correspondence about its decision.
- The winner will be confirmed on 05/04/12.
- The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- The prize
- The prize for the iiNet Top Geek winner is an international holiday package worth a maximum value of $10,000 AUD to be spent by iiNet on one of a number of available travel packages to the international conferences disclosed on the competition website.
- The final package will include travel, accommodation, local transportation, conference attendance tickets and a set amount of spending money. All of this will be organised by iiNet.
- Runners up prizes will only be awarded to those who have made it into the Top 5. The prize for each is a national holiday package worth a maximum value of $1000. The package will include travel, accommodation, local transportation and conference attendance tickets. Spending money is not included. All of this will be organized by iiNet.
- Prizes cannot be transferred or exchanged and must be redeemed within 18 months from the date that the winner is notified.
- In order to claim their prize, each winner must supply proof of identity.
- Intellectual property
- By entering a submission, you agree to assign all rights in the submission and any other material submitted as part of or in connection with a submission (“material”) to iiNet. You consent to iiNet using the submission and material in any manner iiNet wishes (including modifying, adapting or publishing the submission and material in whole or in part or not at all), by way of all media, including, without limitation, posting your submission and material (whether in original form or a modified or adapted by iiNet as permitted under this paragraph) on iiNet’s website and social mediums without payment to you (of royalties, compensation or otherwise)
- General terms
- Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify contact details provided in an entry should be directed to the Promoter.
- The Promoter and its associated agencies and companies are not liable for any loss or damage suffered (including but not limited to indirect or consequential loss either directly or indirectly) as a result of entering this promotion, or receiving, accepting or using any prize, except for any liability that cannot be excluded by law.
- The decision of the Promoter in relation to any matter concerning the promotion will be final and no correspondence will be entered into.
- If for any reason this promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the promotion including the prize, the offer period and these conditions of entry.
- All personal information is collected for the purpose of the conduct of the competition. This information will not be disclosed to any other organisation except with the express consent of the entrant. Failure to provide the information required will result in the entry being void.
- The promoter is not responsible for loss of the prize.
- The promoter reserves the right to syndicate activity to any and all social media websites nominated by the contestant or any person engaging with the competition.
- The promoter reserves the right to alter the structure of the competition, the entry requirements and any other aspects of the TopGeek 2.0 competition at its discretion.
